In India, skill-based games, such as online fantasy sports, are generally legal and accepted, with some exceptions based on regional regulations. The Public Gambling Act, 1867 (“PGA, 1867”) governs gambling activities in India, defining “public gambling” and the operation of gaming houses as criminal offenses.

However, the PGA does not apply to games that are predominantly based on skill. Online fantasy sports fall into this category because they require participants to use their skills, knowledge, and judgment to build and manage their teams. This exemption from the PGA means that skill-based fantasy sports are not subject to the same legal restrictions as games of chance.

SIKKIM, ASSAM, ODISHA, TELANGANA , ANDHRA PRADESH AND NAGALAND

While online fantasy sports are broadly recognized as legal in India, certain states have enacted their own regulations that may affect the operation of fantasy sports platforms. In states such as Sikkim, Assam, Odisha, Telangana, Andhra Pradesh, and Nagaland, the legal framework surrounding skill-based games and online fantasy sports remains unclear or restrictive.

In response to these regional regulations, Tencricplay restricts residents of these states from participating in paid fantasy sports contests. This precaution is taken to ensure compliance with local laws and to avoid legal complications. Users from these states can still enjoy free-to-play games and contests, but they are not permitted to engage in contests that involve monetary stakes.
